Clear terms for using GuestSence.

These Terms describe the basic rules that apply when a restaurant, guest or other user accesses GuestSence.

1. About GuestSence

GuestSence is restaurant guest feedback software. It helps restaurants collect private feedback, organize follow-up work and track structured improvements.

2. Acceptance of these Terms

By accessing or using GuestSence, you agree to these Terms. If you use GuestSence for a restaurant or another organization, you confirm that you are authorized to act for that organization.

3. Restaurant and Merchant responsibilities

Restaurant and Merchant users are responsible for:

  • keeping account and restaurant information reasonably accurate;
  • protecting login credentials and limiting access to authorized people;
  • using GuestSence lawfully and obtaining permissions needed to process information submitted to the service;
  • reviewing feedback and deciding what action is appropriate for the restaurant; and
  • using guest contact details only for the follow-up the guest permitted.

4. Guest feedback

GuestSence provides tools for collecting and organizing feedback. It does not guarantee that every submission is accurate, complete or authentic, or that acting on feedback will produce a particular rating, revenue or operational result.

5. AI-assisted features

Some GuestSence features may use AI to prepare drafts, summaries or suggested actions. AI output may be incomplete or inaccurate and must be reviewed by the restaurant before use. It is not legal, financial or other professional advice.

6. Account security

Merchant users should keep credentials confidential and notify GuestSence promptly if they suspect unauthorized access. A restaurant is responsible for activity carried out through access it has authorized, except where responsibility cannot legally be assigned in that way.

7. Acceptable use

You must not use GuestSence to:

  • break the law or violate another person's rights;
  • access or attempt to access another restaurant's information;
  • interfere with, overload or disrupt the service;
  • circumvent authentication, access controls or security measures;
  • submit malicious code or use harmful automated activity; or
  • harass, deceive or misuse guest contact information.

8. Service availability

GuestSence is provided on an as-available basis. The service may occasionally be unavailable because of maintenance, updates, third-party services or circumstances beyond reasonable control. No specific uptime commitment applies unless it is agreed separately in writing.

9. Trial and paid subscription

GuestSence may provide an evaluation period before paid access. The current standard restaurant trial is 14 days unless a different written arrangement is agreed.

The standard paid plan is US$499 per restaurant for a 12-month subscription. The applicable price, billing frequency and taxes are shown before purchase.

A GuestSence trial does not itself create a Paddle subscription or charge. A paid annual subscription begins when the restaurant affirmatively completes the purchase.

10. Automatic renewal and cancellation

Unless the purchase screen states otherwise, an annual GuestSence subscription renews automatically for successive 12-month periods until canceled.

A restaurant may cancel future renewal through the subscription-management method provided with its order or by contacting support. Unless otherwise required by law or an approved refund, cancellation takes effect at the end of the current paid subscription period.

If a renewal payment cannot be collected, Paddle may retry the payment and the related GuestSence paid access may be restricted or end when the subscription is no longer valid.

11. Payments and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns

For orders processed through Paddle, Paddle processes the transaction as the online reseller and Merchant of Record. Paddle handles payment processing, applicable transaction taxes, order receipts and payment-related buyer support. GuestSence remains responsible for providing and supporting the GuestSence software.

GuestSence does not receive or store full payment-card numbers or card security codes for Paddle-processed transactions.

12. Cancellation and refunds

Cancellation prevents future renewal but does not by itself create a refund for the current paid subscription period. Refund eligibility is separate from cancellation and is described in the GuestSence Refund Policy.

Refunds for Paddle-processed orders are handled through Paddle. Nothing in these Terms or the Refund Policy excludes or limits rights that cannot lawfully be excluded.

13. Partner Program

Participation in the GuestSence Partner Program is subject to a separate written Partner Agreement. Public descriptions of the Partner Program do not replace that agreement.

14. Intellectual property

GuestSence software, branding and original product content remain the property of their lawful rights holders. These Terms do not transfer ownership of GuestSence. Restaurants retain their rights in the content they are entitled to submit and give GuestSence permission to process that content only as needed to operate and improve the service.

15. Third-party services and links

GuestSence relies on third-party infrastructure and may link to external services. Those services operate under their own terms and policies. GuestSence does not control or guarantee a third party's service, content or availability.

16. Disclaimers

GuestSence is intended to support restaurant decision-making, not replace it. To the extent permitted by law, the service is provided without promises that it will be uninterrupted, error-free or suited to every restaurant's particular needs. Nothing in these Terms excludes rights or responsibilities that cannot lawfully be excluded.

17. Limitation of liability

To the extent permitted by applicable law, GuestSence is not responsible for indirect or consequential loss arising from use of the service. Any further liability limit must be interpreted in light of the applicable service arrangement and rights that cannot legally be limited.

18. Suspension or termination

GuestSence may suspend or terminate access where reasonably necessary to address unlawful use, abuse, a security risk, non-payment under an applicable arrangement or a material breach of these Terms. Where practical, GuestSence will try to give appropriate notice.

19. Changes to these Terms

GuestSence may update these Terms as the service changes. Material changes may be communicated through the service or another appropriate channel. Continued use after revised Terms take effect is subject to applicable law.
